Agreement for downloaded tracks

It is important that you read and understand this. This is an agreement between you, the purchaser (sometimes known as the "end user") and us, rehearsalpianist.com. It is intended to be legally binding on you and on us. By purchasing and downloading audio files ("mp3's") from our site, and/or by purchasing cd's from us and/or by ordering (a) bespoke mp3('s) to be sent by email, you are agreeing to be bound by the terms of this agreement. That means that you have read, understand and agree to everything which is written in this agreement. Please remember that if you are using PayPal, Visa or any other online system of payment, that these companies will have their own terms and conditions which are also binding on you, and which you should also read, understand and agree to before you make any purchase.

Usage

This agreement permits you to use any files you have downloaded from rehearsalpianist.com for personal use only as a personal rehearsal or practice aid.
You may use them on any computer or any other type of equipment which can play these files.
You may use or adapt the files in any way you choose, provided that it is for your personal and private use only.
You may not sell, swap, loan, rent, lease or give away these files except as follows : you are entitled to give them away as a gift, but if you do so, you must make sure that the recipient reads, understands and agrees to everything in this agreement.
You may not print or transcribe music or lyrics from these files.
You may not copy or reproduce any of the materials on this website in any form whatsoever, whether physical, electronic or otherwise. You may not upload these files to any website or file sharing area or send them by email.
You may not use these files or allow any other person to use these files to make a commercial product. This means that, for example, you may not use these files to make backing tracks, karaoke tracks, or any type of film or television soundtrack or for file sharing or streaming or for any other purpose whether money changes hands or not.
You may also not use these files, or allow them to be used, for file sharing or internet streaming even when no money changes hands, for rehearsal tracks for amateur dramatic productions, as accompaniment tracks for auditions or to be used in classrooms, or in any live performance, whether paid or unpaid, including charity performances. You may not use these files, dispose of them or allow them to be distributed in any way which could damage rehearsalpianist.com.

This agreement does not give you any of the rights of copyright in either the work or the recording. All copyrights and the title associated with these products remain the property of their original owners. No licence of the performance rights to the music and lyrics is either implied or included in this agreement.
You may not create compilations or any other form of work from content on the site.
You may not use any content from the site in any manner that may infringe any copyright, intellectual property right or any other rights of rehearsalpianist.com or of third parties.
You may not remove, decompile, disassemble or reverse engineer any site software or use any network monitoring or discovery software to determine the site architecture.
You may not use any automatic or manual process to harvest information from the site.

Warranty and exclusions

rehearsalpianist.com warrants that the mp3 files purchased will load into any properly maintained and operated device which correctly imports an mp3 file.
The website "rehearsalpianist.com" is provided on an "as is" and "as available" basis. Your use of the rehearsalpianist.com site and content is at your own risk.
To the maximum extent permitted by applicable law, rehearsalpianist.com disclaims all other warranties express or implied, including but not limited to implied warranties of merchantability and or suitability for a particular purpose.
To the maximum extent permitted by applicable law, rehearsalpianist.com shall not be liable for any damages, consequential or otherwise, arising out of the use or inability to use the downloaded files and or the website.
rehearsalpianist.com's entire liability under any provision of this agreement shall be limited to the amount actually paid by you for the downloaded files.
rehearsalpianist.com does not guarantee that the files you have purchased will help you learn the material or that they will help you get an audition or any other form of interview or to gain professional success.
rehearsalpianist.com reserves the right to change or modify any detail of this agreement at any time and that notice that we have have done so shall be provided by posting that fact on the website. rehearsalpianist.com reserves the right to alter the files offered and to change the pricing at any time, without notice. rehearsalpianist.com does not warrant that the site will be continuously available, or available at all.

By accepting this agreement, you agree to indemnify rehearsalpianist.com and hold us and all our staff and providers, howsoever linked to us, harmless from and against any and all liability and costs.
